I'm no expert in litigation, but if it's stipulated as part of your employment that you specifically don't do something (ie visit fan websites) and you do it, I'm not sure you can suggest it is the employer who is somehow at fault/ overly harsh.

It might seem a trivial matter to us, but it was enough of a concern to them (the club) to include it in the first place.

Of course, I'm not in full possession of the facts.
I don't know -for example- whether John signed a contract with that clause included or whether he was simply asked not to in person, on commencement of his employment with AVFC. Maybe the latter would be less watertight/ more open to individual interpretation.

There have been some assumptions made - e.g. that my contract of employment contained this and that. I don't know why it's assumed that way, but the fact is that my contract did not contain any stipulations about issues such as this - a fact that the tribunal quickly picked up on.

If my contract did stipulate such things I would hardly do what I did - unless I were a numbskull. Er, don't answer that!! :-)

The last few comments seem a bit strong. John Lerwell has come on here with an explanatin, and even a bit of an apology. As everyone has said, it was a storm in a teacup, that got blown up out of proportion when someone was a little more sensitive than they perhaps ought to have been. It's happened to us all.

At the end of the day John is an avid Villa supporter, and who provides an informative, if a bit muddled, website, to which I occasionally refer, and for which he should be congratulated, in my opinion. If people cannot be civil to each other, perhaps it is time to give the subject a rest.

Thanks mate. The problem is that those that are using all the unnecessary **** words etc do not know the full picture - nor (I think) does anyone on this site.

Yes, the subject should die a death - let's just leave it.

Incidentally, I'd be very (seriously) interested in what you find on my website that's "muddled".

thought it was all a bit harsh personally. if he'd been having a go at aston villa supporters (which i'm not sure he was really) during office hours then fair enough, but if it was during non-work hours as a civillian then he's just a fan like the rest of us

Yes - it all took place out of work hours, and there was nothing to stipulate restrictions on what I should do out of work hours. Also the fact that I maintained my own site and blog anyway, and did so before I joined the Villa. No mention was made on my joining that I should abandon all that.

Certainly there was no malice intended anyway. That I allowed myself to be goaded was more down to the fact that I was far from being in the best frame of mind at the time - for reasons that would probably be appreciated by you all if they were known.

That's my stance on it.

If theyfound in your favour, then good luck to you, that's what they are for, to protect people. Beyond that, I don't really have an opinion on the tribunal.

I do have an opinion on the way you behaved on here, though, which was arrogant and rude.

Gentlemen ... whatever you say I did and how I did it it on that thread, I have a collection of e-mails from estimable people who had and have quite a different opinion.

I suggest we just let bygones be bygones; that's more preferable all round.
