If you resign because your employer is in fundamental breach of your contract (which would include unwritten terms as to trust and confidence) this counts in law as a dismissal so you can bring a wrongful dismissal claim even if you have resigned. This does not mean that this is necessarily what happened in this case. On the assumption that some money went from AVFC to MON I think his lawyer is entitled to count that as a success. As I understand it the Tribunal did not find in his favour. The case settled part way through which may or may not suggest an indication had been given as to which way the wind was blowing...
