Are Match Tickets Refundable or Not?

Sorry to start a new thread about this but I have 90 minutes left to buy my Bayern ticket and don't know whether to buy one for my dad who has surgery "pencilled in" for the day of the game but has not been confirmed. And the ticket office aren't accepting calls.

state

"1.3 Match Tickets are non-refundable except as stated in these Conditions of Issue."

but then state

"3.2 .... In the event that you are unable to use your Match Ticket you should return it to the Club and a refund will be issued of the face value of the Match Ticket provided it is returned more than 24 hours prior to the relevant Match in accordance with clause 4 below.The Club permits you to transfer your Match ticket to a Guest with the Club’s prior consent. Please contact the ticketing office."

So which is it?

They don’t contradict each other. 1.3 sets out the general rule and then 3.2 provides for an exception to it.
