I was sending out email's to third parties with barely contained glee informing them that they need to cough up and to stick their average spot rate up their backside.

Common sense has prevailed here. Just quite how the pecunious claimant can hire at a hypothetical average rate is beyond me.

Nothing wrong with Bent taking out a like for like car. Its a basic principle of tort. He's paid for a prestigous vehicle and shouldn't have to take a lesser car.
