Unfair dismissal tribunal award
« on: March 02, 2011, 09:42:56 AM »

Intersting having used some evidence from this site. Also ending comments from Villa that even after the award they stand by their decision

I got suspended from school because they didn't like my uniform.

I had no idea people were so sensitive about the Gestapo.

Get the sack from your dream job, then win an industrial tribunal case on a technicality. It's the definition of a Pyrrhic victory. Nice one.

Can't recall that episode on here.

I do remember it.  The gentleman in question was quite haughty in his tone but I can't remember any 'innapropriate' comments.

Still, I guess the thread in question is still here somewhere, unless it got deleted for legal reasons or something.

I won a legal action against Drayton Manor for Funfair dismissal.

I was sacked from my job after an argument about the ethics of wearing fake animal skins in fashion.

I took a case against them for unfur dismissal!

I was sacked because I refused to wear the uniform bell bottomed trousers.

Yes it was unflare dismissal.

Original thread

Read through some of the debate/doscussion/argument and you can see why Villa felt Mr Lerwell behaved innapropriately.  On the other hand it was great Christmas entertainment!

Speaking as an Employment Lawyer it seems to me that the Tribunal decision was correct.

The legal test is whether dismissal without notice was "within the range of reasonable responses" open to the employer. That means the conduct has got to be pretty serious, taking into account length of service, previous record and the like.

While Mr Lerwill was being "precious" I don't see anything that was abusive or which brought Aston Villa into disrepute, so he should not have been dismissed.  Whether he deserved to be told off is another question.

In other news, Quasimodo has been made redundant.

He's got two weeks back pay and a lump sum.

I agree.
Its also sad that many Villa fans find it a reason to 'joke' I'm sure Mr Lerwill found the situation far from funny, especially as he reads, as we all do many a more serious gaff from other Villa employees, that seem to go unpunished.
Its interesting that the might of Aston Villa can be so rocked by a fan on a fan site expressing an opinion. I thought Randy wanted to hear all, the good, bad and ugly.
