I can see how the penalty incident doesn’t happen if the foul if given against Germany on the half way line, but surely that is re-refereeing the game, which VAR isn’t supposed to do.

Not really re-reffing is it. VAR has always been allowed to look at incidents in buildups to pens and goals to call back a decision. If there was not any goal or penalty resulting from it, then they wouldn't have asked the ref to look at it for any other reason.
